An RFE (Request for Evidence) or NOID (Notice of Intent to Deny), while rare in our practice, may occasionally occur, especially if the applicant's profile is not ideal.
If such a notice is issued, we will help gather additional materials and prepare a prompt and thorough response to fully address all USCIS questions and provide additional evidence.
If you apply from within the U.S., your status will change to O-1A upon approval, allowing you to stay and work without leaving the country.
However, if you leave the U.S. (for example, for a trip), you must attend a U.S. embassy or consulate in your country of nationality (your “home post”) or in a country where you hold valid residency in order to obtain the O-1 visa stamp before re-entry.
If you apply from outside the U.S., you must attend a consular interview and receive the O-1 visa before entering the United States.

No, the O-1A visa does not lead directly to a U.S. passport or permanent residency. It’s a non-immigrant visa, meaning it allows you to live and work in the U.S. temporarily – usually for up to three years, with the option to extend in one-year increments.
However, many O-1A visa holders later transition to a green card through an employment-based immigrant route like the EB-1A for extraordinary ability or EB-2 NIW. Once you hold a green card for a sufficient period (typically five years), you may become eligible to apply for U.S. citizenship and a passport.
So while the O-1A itself won’t get you a passport, it’s often a stepping stone toward long-term U.S. residency and citizenship – especially for top-tier talent with a strong track record.
